Kayak Rental Agreement

IMPORTANT NOTICE

By signing this Agreement, I acknowledge that kayaking and all water-related activities involve inherent and significant risks, including serious bodily injury, permanent disability, drowning, death, property damage, and other losses. I voluntarily choose to participate despite these risks.

ELIGIBILITY REQUIREMENTS

I certify and agree that:

• I am at least 18 years of age and legally competent to sign this Agreement.
• Any minor using the kayak is under my direct supervision and responsibility at all times.
• I am physically capable of operating a kayak safely.
• I am not under the influence of alcohol, drugs, medication, or any substance that may impair my judgment or abilities.
• I understand basic swimming and water safety principles.

SAFETY RULES

I agree that I will:

• Wear a properly fitted life jacket (PFD) at all times while using the kayak.
• Use the kayak only during daylight hours.
• Never use the kayak during storms, high winds, fog, rough water, or unsafe weather conditions.
• Never exceed the manufacturer's weight capacity.
• Never stand in the kayak.
• Never tow another vessel or person.
• Never intentionally collide with docks, boats, structures, wildlife, or other persons.
• Remain within designated areas and away from restricted, hazardous, or private areas.
• Not allow unauthorized individuals to use the kayak.
• Inspect the kayak and equipment before use and immediately discontinue use if any defect or unsafe condition is observed.
• Follow all federal, state, and local laws, regulations, and boating requirements.
• Use the kayak solely at my own risk.

ASSUMPTION OF ALL RISKS

I fully understand and voluntarily assume all risks associated with kayaking and water activities, whether known or unknown, foreseeable or unforeseeable, including but not limited to:

• Drowning
• Capsizing
• Hypothermia
• Collision with boats, docks, rocks, submerged objects, or other hazards
• Weather-related injuries
• Equipment malfunction or failure
• Wildlife encounters
• Physical exertion injuries
• Medical emergencies
• Negligence of other participants
• Rescue delays or inability to obtain emergency assistance

I acknowledge that these risks may result in serious injury, death, or property damage.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Property Owner, Property Manager, Airbnb Host, their affiliates, employees, contractors, agents, representatives, heirs, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, expenses, attorney fees, judgments, or injuries arising out of or relating to:

• My use of the kayak or related equipment;
• The use of the kayak by any member of my group;
• Any accident, injury, illness, death, or property damage;
• Any equipment malfunction, defect, or failure;
• Any rescue attempt or lack of rescue;
• Any condition of the water, weather, shoreline, dock, or surrounding area.

This release applies regardless of whether the claim arises from negligence or otherwise, to the fullest extent permitted by applicable law.

INDEMNIFICATION AND HOLD HARMLESS

I agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, expenses, attorney fees, lawsuits, penalties, or costs arising from:

• My use of the kayak;
• The use of the kayak by any member of my group;
• My violation of this Agreement;
• Damage to the kayak or equipment;
• Injury or damage caused to any third party by me or any member of my group.

This obligation survives the end of my stay and remains enforceable indefinitely.

RESPONSIBILITY FOR GUESTS

I accept full responsibility for all members of my group, invitees, guests, family members, children, and any person who uses the kayak under my authority or permission.

I agree that I am solely responsible for ensuring compliance with this Agreement by all such individuals.

EQUIPMENT CONDITION

I acknowledge that:

• The kayak and related equipment are provided "AS IS."
• No warranties, express or implied, are made regarding safety, seaworthiness, fitness, or condition.
• I am responsible for inspecting all equipment prior to use.
• I will immediately stop using any equipment that appears unsafe.

DAMAGE OR LOSS

I agree to reimburse the Property Owner for the full replacement or repair cost of any lost, stolen, damaged, or destroyed equipment caused by me or any member of my group.

SEVERABILITY

If any provision of this Agreement is found unenforceable, all remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS AGREEMENT. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR COERCION.
